Funny: Imagine a Different America

Joke for Thought
The column was a joke (literally). But in addition to being funny, it really says some very interesting things.
Written by Joel Stein in Time magazine (March 24, 2014), it is a blueprint for how the United States should break into two separate nations.
Consider some of what Stein wrote:
• “We should peacefully break into two countries, one made of red states and one of blue. The red one would still be called the United States of America, since it would otherwise have to alter the lyrics of every song its citizens know. The blue one would be renamed something racially inclusive and long and hard to remember. The Exceedingly Long-Named Country would be free to have the laws it has always griped about not being able to pass. Instead of guns, the cops would carry Change.org petitions.”
• “Once the blue states were their own country, they would develop a better appreciation for the South, as a foreign country they could visit when Mexico seemed like too much effort and Canada too little…. A place with the best breakfasts in the entire world. Where it’s easy to navigate since everyone speaks English, but figuring stuff out is still a bit of a fun challenge because, after all, it’s not really English. A place where you can shoot guns, drive cars with combustion engines and drink beer that isn’t painfully bitter—all at the same time.”
• “This split would in no way prevent Southerners [and Westerners] from vacationing up North for the same reasons they always have: they have relatives there and have no choice.”
Again, though meant as a joke, this describes some of the real differences between the Blue and Red states. Klein continues:
• “The South…could pass laws every month not to raise its debt ceiling since, let’s face it, no one is going to lend a Southerner money.” The North “could make environmental treaties with foreign nations about how to extract natural resources, since they’ll have no natural resources anyway.”
Very funny.
The Un-United States
What’s missing in Stein’s fictional proposal is how the southern red states and the western red states will get along. Since they won’t, they’ll just split too.
And what about the swing states? Florida, Ohio and West Virginia have a lot more in common with each other than most of their geographical neighbors, so maybe they’ll break away and create a fourth nation.
Colorado is part of the blue states anyway, so geography is already archaic in the new system.
But that’s just the beginning. Nevada and Utah are basically the opposite of each other, but Nevada is also the opposite of California—in a totally different way.
Nevada can’t co-exist well with either, but it can connect with Arizona and Montana.
Texas will probably want to its own nation. And that’s just the start…
Time to Stop Laughing
The more I think about it, the less funny it is. People who just want Washington to get along sometimes miss a key truth: the conflict in Washington is a lot less extreme than the conflict would be between capitol cities of competing nations.
As John Jay wrote in Federalist Paper 5:
“Should the people of America divide themselves into three or four nations…envy and jealousy would soon extinguish confidence and affection, and the partial interests of each…instead of the general interests of all America, would be the only objects of their policy and disputes. [Afterwards], like most other bordering nations, they would always be…involved in disputes and wars [with each other].”
The result, Federalist 5 said, would be, first, that America would be weak against all its foreign enemies, and second, the new blocs of states would be dangerous “and formidable only to each other.”
Why Washington Feels Broken
Sometimes it’s nice to sit back and laugh at ourselves.
Yes, Washington can be a frustrating, angry, and dysfunctional place, but it could be a lot worse. Southern and Northern California could be two separate nations, for example. Or Michigan and Ohio. Atlanta and Athens, Georgia. Manhattan and the Bronx.
Talk about conflict. The thought makes Democrat versus Republican feel tame.
The U.S. is not, at it’s essence, federal. The Founders created the federal government as a national security entity that would protect, and loosely cobble together, thirteen distinct states.
When the federal government tries to homogenize fifty unique states, treating them with a one-size-fits-all mentality, the result is dysfunction.
Washington feels “broken” today because it is. It is trying to do something it was never designed for.

How to Deal With the BLM (A Modest Proposal)

Here a -Gate, There a -Gate
The IRS targeting scandal and BLM-gate in Nevada hit the news again this week. If you missed these two huge stories, do a quick web search and catch up on the news. Both may be precursors of a Constitutional crisis. Add the shocking turn of events (and aftermath) surrounding Benghazi as well.
The truth is, there is a fundamental problem with the way our government works right now. It is structurally broken, and without a real fix things are going to continue to decline. Washington and its out-of-control agencies and branches will continue to expand—breaking the bank and reducing the freedoms of our nation with every advance.
The problem is that the President and Executive Branch are engaged in domestic policy. Period. The framers only wanted the President to deal with national security.
This is a massive change, and it creates an almost insurmountable national crisis.
As long as this is our system, national crises are going to continue. Like dominoes falling, we’ll witness once crisis after another.
People will wonder why Washington can’t get it right, but few will realize the truth: The federal government simply isn’t well designed to do what it is doing. It is designed to be tough on foreign enemies, to leave interactions with its own citizens to the state and local governments.
What’s Washington “For”?
This bears repeating until every American figures it out:
- The federal government is designed to stop foreign attackers.
- It is designed to keep the President from becoming a tyrant while he still has enough massive power to effectively repel any security threats to the nation.
- It is designed with a congress that has the power to ensure that the states help fund and support whatever it takes to stop any attacks on the nation.
- It is designed to allow the Court to settle disputes between the states in a peaceful manner.
These are, fundamentally, all the federal government is supposed to do. This is how the Constitution was written.
Today the federal government acts like these Constitutional responsibilities are just minor duties, afterthoughts really–as if funding and managing myriad federal programs in every walk of life and in every small town or valley, home and business across the nation is their real job.
As long as this is the case, America will decline.
On the one hand, we’ll decline because Washington too often uses its power stupidly—sending the BLM to shoot a rancher’s cattle or using the IRS to investigate political rivals. But this is natural to a government that was set up to fight its enemies.
The Executive Branch thinks like what it is: a national security apparatus.
And in the context of security issues, the Congress thinks like what it is: an arm to raise funds for the Executive and simultaneously keep the Executive from becoming tyrannical.
All of this is excellent when it is pointed at real threats to America. How about: use the resources of the BLM, IRS, ATF, FDA, etc. on Iran, Iraq, North Korea, China, Russia? See how Putin deals with that!
Misdirection
The truth is, the tactics used by many of our federal agencies would be much better suited against Putin’s Russia than our current international policies.
Sadly, they are used more often against our own people than against our adversaries. Sic the NSA on the phone records of China and Iran, not Burbank or Atlanta.
When the national security apparatus (which should be synonymous with “Washington D.C.”) targets Americans, it does so in the wrong way. It was never designed as a government to oversee its own people. The framers structured it specifically for national defense.
The states and local governments were supposed to do the governing of the people. Read the Constitution. Read the Federalist Papers. This focus was clear.
The second problem, the second reason our system is broken, is that in focusing on domestic governance (unconstitutionally), the federal government is less likely to do its real job—national security.
Why do we send federal agents against a rancher in Nevada or conservative groups applying to the IRS, but send nobody to protect our diplomats in Benghazi?
The federal government has forgotten why it exists.
It spies on its own people, but does nothing except bluster as Iran fails one nuclear inspection deadline after another.
Domestic policy and politics get in the way every time the Congress or the Executive Branch want to do what really should be done for national defense.
We let Putin or China get away with, literally, murder and torture because our federal leaders are afraid to take a stand that might jeopardize them politically.
Here’s a thought…
If the federal government only dealt with national defense, including mitigation of disputes between states, it wouldn’t have this concern. It would take Putin on with strength—the way the ATF and BLM deal with American citizens.
The irony here is shocking.
We putter around with true dictatorship such as North Korea and Iran, and try to make friends with raw aggression from Russia.
The federal government talks big against Putin and China, but it only actually bares its teeth when faced by a one of its own senior citizens and a few cattle.
Again, the Constitutional structure is going unheeded. Until we simply follow the Constitution, our decline is assured.
But what can we do? What are the realistic policies or changes that can fix our plight?
It’s great to talk about the ideals of the Constitution, but what about real solutions?
I agree–we need real changes. So here’s my proposal:
Let’s convince the Obama Administration and Congress to round up all agents who carry guns for the BLM, ATF, IRS, NSA, FDA and any other federal agency and ship them to the Ukraine.
This won’t consist of sending “military” forces because they’re not soldiers, they’re bureaucrats.
It won’t hurt the United States, since the absence of thousands of meddling federal officials will likely cause an economic boom in America.
It will be a real blow to Putin’s aggression, however. They U.S. bureaucrats speak his language.
They’ll cite policies, procedures, precedents, and email/phone data they’ve been secretly collecting on Ukrainians for many years. Putin’s people won’t know what hit them.
When the Russians threaten violence, our “Bureau Team Six” will just make up their own laws, agency rules, and executive orders and enforce them.
No matter how the Russian generals respond, they’ll have an answer: “Who cares what the people on the ground think?” “Who cares what the Constitution says?” “Logic and common sense? What’s that got to do with anything?” “Come on, Putin, just do what we say.”
If all else fails, Bureau Team Six will just write up some new policies and print them out on their laser printer. Then they’ll point to these “laws” and tell the Russians that this is agency policy with the full backing of the U.S. federal government.
Indeed, this Corps of Really Armed Bureaucrats (CRABs) is already highly trained in the exact tactics that will put Putin’s power grab in its place.
When they’re done in the Ukraine, let’s send them to North Korea. They should be able to shape things up quickly.
Then on to Iran.
Back at the Ranch
Meanwhile, the economy at home will be booming.
Less regulation will foster more opportunity.
Fewer dogmatic enforcers will encourage innovation and increased prosperity.
International investors will move their money to American businesses, and employment and salaries will increase.
It’s amazing how quickly things can be fixed when we simply follow good principles. The Constitution is actually a really good idea. We should consider following it.
Conclusion
Satire aside, our system really is broken, and nothing will fix it until the federal government gets out of the governing business and gets back to focusing exclusively on national security. If this is too big a change, then the U.S. cannot stand as a free nation.

What Russia Is Up To -or- The Election of 2016 Predicted

Understanding Putin
When Mitt Romney said during the 2012 presidential campaign that Russia is America’s biggest international foe, President Obama and the entire national security establishment laughed and poked fun at him.
They collectively called his views outdated. Quaint. Out of touch.
Nobody’s laughing today. The experts were wrong. Romney was right. Moreover, he did something that may be the most important trait for a U.S. president to display: he read foreign leaders correctly. Despite the experts, even in the face of widespread ridicule, he understood Putin.
In contrast, President Obama has proven that this is a major weakness of his leadership. Reading Putin wrong is a serious problem. Obama read Putin wrong during the Syria crisis, when deciding whether or not to remove strategic missiles from Eastern Europe, regarding Iran, on harboring Snowden, and most recently during the Crimean emergency.
President Obama warned Putin that there would “be consequences” for Russia if it pursued these power grabs. But so far this has been mostly bluster, hardly any meaningful consequences.
Clearly Putin has read Obama right: a politician, someone who thinks words matter more than might, a head of state who shies away from real conflict, a president who will back down in the face of actual force.
Putin’s policy has been to nod, agree, and make nice when words are at play, then to stay silent and let the politicians debate and posture while the troops march in. He has does this in each of the cases mentioned above.
Putin isn’t a politician, not in the Western sense. He is an old KGB operative, trained and conditioned that physical actions speak louder than words. He is convinced that the Obama Administration will rise to mere words when a debate is needed, but back down from physical force.
Putin is also following the old KGP agenda of reestablishing the Russian empire—one piece at a time. For Putin, it’s two steps forward, one step forward.
Looking the Wrong Way
Meanwhile, the NSA and other agencies under Obama’s watch use massive resources spying on Americans, resources that could be utilized spying on Russia and other true security threats.
The clip of President Obama telling Putin that he’d have more flexibility to work with Russia once he won the 2012 election has been played repeatedly. Since it was captured on an open mike blunder when Obama didn’t realize he was on the air, it has fueled numerous conspiracy theories.
But few have pointed out perhaps the most interesting part of this clip: the look on Putin’s face.
The operative, the bully, the bad cop, realizing that his biggest foe, the American president, is a talker above all, that he wants to be liked, that his words don’t directly correlate with his action.
That he can be swayed, even shocked, by violence.
That raw physical force is outside his comfort zone.
That he probably won’t pull the trigger unless he can be almost entirely sure that the other guy can’t fight back.
Is this what Putin was thinking?
Whether or not this is actually President Obama’s character, it is clearly how Putin has sized him up.
They’re Not Playing Games
The Administration makes war on Fox News, Edward Snowden, Ted Cruz, Bill O’Reilly, anti-Obama Care Republicans, or conservative groups seeking IRS approvals, but Syria, Iran, North Korea, and Putin get to do whatever they want.
Putin has apparently decided that he can operate without any real opposition from the White House. No discussion, no diplomacy, no talk needed, until the power has been wielded.
Afterword, once the troops have done their work, Obama will be only too happy to talk with Putin, to smooth things over, to declare “peace in our time” based on nice words and promises.
For Putin, Obama is Neville Chamberlain, so interested in peaceful words that they can be used after aggression to cover any sin. No need for permission when apologies will suffice.
While the phrase “Putin is playing chess while Obama is playing checkers” makes its rounds inside the Beltway, the truth is a bigger concern:
Putin is playing Stalin and Obama is playing Carter.
What we need from our president in national security is a Truman, a Churchill, a Thatcher, a Reagan—someone that a Khrushchev, Brezhnev, or Putin has no choice but to respect.
Because even though Putin doesn’t bother anymore to care what Obama is doing or thinking, now that he has pegged him as an easy mark, China and Iran are watching. Closely.
How did we get to this point?
High School Politics in Washington
Americans elect the “cool” candidate as president in the Entertainment Age. Carter was cooler than Ford, Reagan was cooler than Carter and Mondale, Bush I was cooler than Dukakis but not as cool as Clinton, Clinton was cooler than Dole, Bush II was cooler than Gore and Kerry, and Obama was cooler than McCain and Romney.
A simple “cool” test (who is more likely to sing, dance, play the saxophone, fuel high school ambitions in the youth, etc.) would have accurately predicted every one of these elections.
It’s High School Musical at the White House.
As for the 2016 presidential election, no potential candidate so far is nearly as “cool” to a majority of the national electorate as Hillary Clinton. Nobody is even close.
The problem is that when it comes to the main Constitutional role of the Chief Executive (keeping the nation safe from foreign aggression), teenage-style “cool” is arguably irrelevant.
The most important trait may well be the ability to effectively size up foreign leaders and project real strength to them. Rahm Emanuel, Mitt Romney, Bill Clinton—Putin would tread more lightly.
But since we are caught in this Entertainment Society where the political parties pick their presidential candidate based on ideology mixed with electability, and then the American voters reject both of these and simply elect the “cool” candidate, maybe the best we can hope for is a president who demands respect—not from the Nobel Prize committee of idealists but from dangerous world leaders like Putin.
Ironically, this is becoming increasingly important as the current Administration drastically cuts the military (and ramps up debt, inflation, and spending on everything else), and as a number of nations become closer in the balance of power to the United States.
More military conflict will certainly happen in the coming two decades. Russia, China and many nations in the Middle East are actively and specifically preparing for this.
The U.S. is doing the opposite—cutting the military and looking for the next Zac Efron as president—hoping that no conflicts come.
But they will.

How to Solve the Immigration Problem

I finally read a proposal in the mainstream media for an immigration policy that is based, at least partly, on the American founding model.
The solution was suggested by Jagdish Bhagwati and Francisco Rivera-Batiz in their recent Foreign Affairs article, “A Kinder, Gentler Immigration Policy.”
This is exciting, and this can work.
The proposal boils down to this: Let the states try their own ways of handling immigration.
The results of such a policy would be interesting. At least one or two states will likely take a hardline policy against immigration, and a few will no doubt adopt a more lenient approach. Most will probably choose policies that are more in the middle.
As this happens, we’ll get to watch the results. Will the hardline states see negative social and economic consequences, or will the results be positive? What will happen in the states with lenient immigration policy?
States will have to decide whether to pay for the education and medical expenses of illegal immigrants, and how to deal with other issues that are truly, according to the Constitution, meant to be local and state issues anyway.
They will have to determine how to assess taxes from illegal workers, and how to respond to businesses that hire illegal immigrants in ways that bring the most benefit to the state, and they are much more likely than any federal agency to do these things effectively.
Over time, legislatures and courts will learn from these examples and trend toward the policies with the best results.
Not everything needs to be done from Washington. In fact, the founders specifically wanted most things to be done at the local, and if necessary, state levels.
A full 28 percent of Federalist Papers are dedicated to supporting this very point — what can be done by the states should not be done by Washington (see Federalist 17,23-30,33,41-51,53,59-60).
Critics will argue that illegal immigration poses a number of national security threats, and that national defense is clearly a federal issue. To address these important concerns, we can amend the proposal as follows:
- Secure the border, to fully protect our national security.
- Let the states try their own ways of handling immigration.
If history has shown us anything, it is that one of the fifty states is a lot more likely to adopt the right policy than Washington.
In fact, if the issue is left to Washington, it is doubtful whether we’ll ever get an effective policy — and many people feel that if Washington does pass something it may well be more bad policy.
America was founded as a federal republic, where the individual states were designed to laboratories that could teach each other — and Washington — what works and what doesn’t.
The wisdom of the framers can help us today in the debate on immigration.

What is Freedom?

I frequently get asked something along the lines of, “Oliver, you talk a lot about freedom; but what, exactly, do you mean by the word ‘freedom?’ How do you define it?”
It’s a very good question. To answer it, I first want to define “liberty.” After all, the Declaration of Independence boldly affirms that among our inalienable rights are “…life, liberty, and the pursuit of happiness.”
Actually, the key word in this sentence is “inalienable,” and everyone should read the excellent article by Kyle Roberts on what this word really means.
Liberty and freedom are similar, but they are slightly distinct, and understanding them both is essential in a society that is losing its freedoms.
Liberty
As for “liberty,” I define it as “the right to do whatever a person wants as long as it doesn’t violate the inalienable rights of anyone else.” Of course, in order to exercise liberty, a person needs to know what inalienable rights are—otherwise, he won’t know whether or not he is violating them.
Thus knowledge and wisdom are required to maintain one’s liberty, because a person who violates somebody else’s inalienable rights naturally forfeits his own liberty. The extent of this forfeiture is equivalent to the depth of the violation—when this is applied well, it is called justice.
License
License, as opposed to liberty, is defined as “the prerogative to do whatever a person wants or is able to do.” Note that this has often been used in history as an excuse to plunder, force or otherwise violate the rights of others. Thus license and tyranny are nearly always connected—the tyrant is tyrannical precisely because he takes license as he wills, and the person who pursues license eventually exerts tyranny of some kind.
Sometimes people pick one of the inalienable rights and use it to define “liberty,” such as: “Liberty is the right to do whatever a person wants as long as it doesn’t violate the property of another. Or … the life of another, etc. The problem with this type of definition is that though it is often accurate, it is also too limited. The violation of any inalienable right takes away one’s liberty.
Now that we have a definition of “liberty,” we can also define and compare the meaning of “freedom”:
Liberty: The right to do whatever a person wants as long as it doesn’t violate the inalienable rights of anyone else.
Freedom: A societal arrangement that guarantees the right of each person to do whatever he/she wants as long as it doesn’t violate the inalienable rights of anyone else.
“Liberty” comes from the Latin root liber though the French liberte, meaning “free will, freedom to do as one chooses … absence of restraint” (Online Etymology Dictionary). In contrast, the word “freedom” was rooted in the Old English freodom, which meant “state of free will; charter, emancipation, deliverance” (ibid). Thus liberty could exist with or also without government, but freedom was usually a widespread societal system that required some authority to maintain it.
In most eras of history, the goal is liberty, but it is almost never maintained without freedom. In other words, it is possible to have liberty without freedom, but in such cases it seldom lasts very long and it is usually only enjoyed by a limited few.
When freedom is present, however, liberty exists for all who don’t violate the inalienable rights of others.
What About Now?
This trip down memory lane has an important current application. A lot of people want liberty; in fact, nearly everyone desires liberty. But the only duty of liberty is to honor the inalienable rights of everyone else, and as a result liberty without freedom is fleeting.
In contrast, freedom requires many more duties, and therefore it musters much more from its people. It only succeeds when the large majority of people in a society voluntarily fulfill many duties that keep the whole civilization free.
To repeat: those who stand for freedom must honor the inalienable rights of all, and they must also take responsibility for standing up and helping ensure that society succeeds. No truly free government directs this free and voluntary behavior, but without it freedom decreases.
For example, one of the duties of those who support freedom is free enterprise—to take action that improves the society and makes it better. No government should penalize a person who does not do this (such penalties would reduce freedom), but overall freedom will decrease if a person has the potential to take great enterprises that improve the world, but doesn’t.
Thus freedom is very demanding. If people don’t voluntarily do good things, and great things, freedom declines. If they don’t exert their will and take risks to improve the world, freedom stagnates and decreases.
Freedom and Morality
Another way that people voluntarily increase freedom is by choosing morality. In societies where a lot of the people don’t choose a moral life, liberty may be maintained by some people but the freedom of all people eventually declines. When more people choose the path of virtuous living, freedom grows.
The same is true of charity and service. When more people choose it, freedom increases. There are a number of other ways people can voluntarily take actions that have a direct and positive impact on freedom. In the freest societies, a lot of the people choose to engage in many such behaviors.
When we pledge allegiance to the flag, we do so to promote “…liberty and justice for all.” This is the role of government—liberty and justice, or in other words the protection of inalienable rights and the providing of recompense if such rights are violated.
But while in free nations government is limited to this role, the people in a free society must do much more. If they all do their best, fully living up to their potential, freedom greatly increases.
In other words, the real question isn’t “What is freedom?” but rather “What is my role in freedom?”
The answer is different for each person, but the key is to not worry about how other people use their freedom. As long as they aren’t violating inalienable rights, they won’t hurt you.
